FasFood is a service of 96 Studios – a technology and creative agency. We are strictly a software provider. We do not own, operate, or control any shop. We have no involvement in customer-shop disputes, food quality, refunds, or delivery. By registering and using the FasFood platform, you acknowledge and agree to these terms.
1.1 We Are a Technology Provider Only. FasFood (a service of 96 Studios) provides a software platform (SaaS) that enables Shops to manage online ordering, menus, and operations. We do not own, manage, or operate any food business.
1.2 No Agency or Partnership. These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship.
1.3 Shops Operate Independently. You are solely responsible for food quality, safety, delivery, customer service, refunds, legal compliance, and all disputes with your customers. FasFood / 96 Studios does not mediate, investigate, or resolve customer-shop conflicts.
1.4 No Customer Reporting to FasFood. Customers have no right to report complaints to us about your shop. If a customer contacts FasFood, we will redirect them to you. We do not accept, process, or act upon any customer complaints regarding food, service, or delivery.
2.1 License Grant. FasFood grants you a non-exclusive, non-transferable, revocable license to access the FasFood platform (admin dashboard, menu tools, order management) for operating your food business.
2.2 Restrictions. You may not reverse engineer, modify, copy, or misuse the platform. You may not use the platform for illegal activities or to scrape customer data beyond order fulfillment.
2.3 Account Security. You are responsible for safeguarding your login credentials. Any activity under your account is your responsibility.
3.1 Sole Responsibility for Customers. Your relationship with customers is entirely separate from FasFood/96 Studios. Any agreements, promotions, or guarantees you offer are binding only on you.
3.2 No Customer Complaints to FasFood. Customers cannot file complaints against Shops with FasFood. We do not investigate or take action based on customer reports. All customer service issues must be handled directly by the Shop.
3.3 Indemnification. You agree to indemnify, defend, and hold harmless FasFood, 96 Studios, and their officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (i) disputes between you and your customers; (ii) food quality or safety claims; (iii) violation of any law by your Shop; (iv) any injury or damage caused by your products or services.
3.4 No Liability for Disputes. Under no circumstances shall FasFood or 96 Studios be liable for any direct, indirect, or consequential damages arising from any argument, conflict, or dispute between you and any customer.
4.1 Monthly Fee Structure. Your monthly subscription is calculated as follows:
4.2 First Month Free. New Shops receive the first month free of charge ("pay_next" status).
4.3 Due Date & Grace Period. Fees are due on the 1st of each month. A 3-day grace period applies (payment by the 3rd is considered on time). Accounts unpaid after the 3rd will be marked "Overdue".
4.4 Suspension for Non-Payment. FasFood may suspend or terminate access for overdue accounts. Reactivation incurs a R100 penalty.
5.1 Suspension. FasFood may suspend your access for non-payment, violation of these Terms, or any activity that threatens platform security.
5.2 Termination by You. You may terminate your account at any time by contacting support. Fees already paid are non-refundable.
5.3 Termination by Us. We may terminate your account for breach of these Terms. A penalty fee may apply for reactivation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FASFOOD PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. WE SPECIFICALLY DISCLAIM ANY LIABILITY RELATED TO FOOD QUALITY, SAFETY, DELIVERY, OR CUSTOMER DISPUTES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FASFOOD OR 96 STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY DISPUTE BETWEEN YOU AND YOUR CUSTOMERS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
8.1 No Refund Obligations. FasFood/96 Studios has no obligation to issue refunds to your customers. Refunds, credits, or adjustments are solely your responsibility.
8.2 No Mediation. We will not mediate, arbitrate, or involve ourselves in any dispute, argument, or conflict between you and any customer. We will not accept or process any customer complaints about Shops.
FasFood reserves the right to modify these Terms at any time. Material changes will be notified via the admin dashboard or email. Continued use of the platform after notice constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.

By registering for and using the FasFood platform (a service of 96 Studios), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You specifically acknowledge that FasFood / 96 Studios is not responsible for and will not be involved in any disputes between you and your customers.
